Lead Dentist At Smile Brands Accused of Sexual Harassment

Sexual harassment in the workplace can lead to serious problems for a company, including an expensive lawsuit. The Fort Worth Star-Telegram reports that a discrimination suit was filed by the U.S. Equal Employment Opportunity Commission after accusations were made that a Burleson dentist sexually touched two employees at his practice.

The sexual harassment allegations were made against Dr. David Mikitka, who is reportedly the lead dentist at Smile Brands of Texas. However, David Mikitka is not a defendant in the sex discrimination case. Smile Brands, which does business as Monarch Dental Associates L.P, has been named as the defendant because managers of the dental business failed to prevent or correct the alleged harassment at the dental practice.

The conduct that David Mikitka was accused of includes incidents in which the dentist allegedly talked about sex, directed unwanted sexual comments toward another employee, and touched the employee in a sexual manner.

According to FindLaw, sexual harassment is a considered to be a form of sex discrimination, which is a violation of Title VII of the Civil Rights Act of 1964. Unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature can all be considered forms of sexual harassment.
