Employee of Pilgrim's Pride Sues After Being Denied Bathroom Break

Orvin Roy LaForce Jr. claimed that he had a medical condition that caused him to urinate frequently. As an employee of the chicken company Pilgrim's Pride, he asked his supervisor for extra bathroom breaks and provided a letter from his physician explaining his condition, according to the Southeast Texas Record. Yet he claims that his supervisor told him that he could only go to the restroom on scheduled breaks and that he would not receive special treatment.

By not allowing extra bathroom breaks, Orvin Roy LaForce claimed that he had no choice but to repeatedly urinate on himself. He resigned from his position due to the harsh treatment and has since filed a lawsuit against the company. With help from an employment lawyer, the plaintiff is alleging violations of the Americans with Disabilities Act (ADA).

Under ADA, employers with 15 or more employees are not supposed to discriminate on the basis of disability. FindLaw states that under ADA, employers are also supposed to provide reasonable accommodations for those employees with disabilities. Allowing a few extra bathroom breaks in a day could usually be considered a reasonable accommodation.
