Nurse Files Class Action Lawsuit Over Unpaid Overtime Wages

Lisa Tice, a vocational nurse working for AOC Senior Home Health Corp., claims that she was given an option at the beginning of her employment to be paid overtime or be paid "straight time." The Southeast Texas Record reports that choosing the straight time option would mean that the nurse would not be paid time-and-a-half for hours worked in excess of 40 hours per week. However, nurses who chose the overtime option would not usually be given hours in excess of 40 hours per week.

In order to get be scheduled for the most work hours, Lisa Tice chose the straight time option. Yet an employee is not allowed to waive his or her rights to overtime compensation under the federal overtime laws without the Department of Labor or Court approval. The vocational nurse has proposed a class action lawsuit against the company, alleging that the nurses with AOC Senior Home were wrongfully classified as exempt from overtime, violating the Fair Labor Standards Act (FLSA).

With help from a Texas employment lawyer, the plaintiff in this case is seeking damages for overtime compensation, lost wages, liquidated damages, interest, court costs and attorneys' fees.

Under FLSA, there are several categories of workers, such as executives and professional employees, who are exempt from overtime pay. However, there are many employees that are wrongfully classified as exempt, in which legal action can be taken.
