How to Prepare for an Unemployment Hearing

When a worker becomes unemployed, FindLaw states that the former employee can apply to temporarily receive benefits from a state unemployment compensation fund until they find another form of work. However, former employees are only entitled to the unemployment benefits if they have been put out of work through no fault of their own.

After a claim is filed, the state agency will make the initial determination if the former employee is eligible to receive unemployment benefits. If the employer believes that the former employee is not eligible or if the employer has any sort of dispute with the claim, then the employer can contest the claim in court.

Houston employment lawyers say that an employment hearing is often no different than a trial. Claimants should prepare in advance what they would like to say and consider hiring an employment lawyer to argue a case. A claimant should also prepare on how to handle the tough questions from an employer if he or she is cross examined.

FindLaw recommends not to become emotional or get into an argument at the hearing, as it can be seen as unprofessional. Don't forget to arrive at the hearing in proper attire, ideally dressed in business clothes. Once you are notified of the court's decision, which will probably be in a few weeks time, be sure to carefully read the judge's opinion. If you lost the decision or feel that the ruling was incorrect, you can usually file for an appeal and have your case reconsidered.
