Age Discrimination in the Workplace

Did you know that it's illegal for an employer to discriminate against job applicants and employees on the basis of age?

At the federal level, the Age Discrimination in Employment Act (ADEA) prohibits employers from discriminating against employees based on age; at least employees who are 40 years of age and older, according to FindLaw. It could be very difficult to prove that an employer has been discriminatory on the basis of age, but in Texas there are many Houston employment lawyers that can help. It's important that the employee shows that there has been some sort of adverse action taken on the basis of his or her age in order for a discrimination lawsuit to be successful.

A recent case in Celina, Ohio illustrates how age discrimination can be a big deal no matter what state you're living in. The Evening Leader reports that Brent Stocksdale, an employee at Wright State University-Lake Campus, claims that there has been age discrimination at the Lake Campus and that the discrimination is interfering with his ability to perform his job. Mr. Stocksdale described the work environment at the Lake Campus as "hostile" in court documents, saying that there is favoratism among the young female workers in the office. The case is now ready for trial.

In Texas, there are many employees and job applicants that have been discriminated based on age, but they probably are unaware that this is in fact illegal.
