Employee Files Suit Against Beaumont Health Care Center

Injuries can sometimes lead to unexpected lawsuits within the workplace. The Southeast Texas Record reports that a Texas woman filed a lawsuit last month in Jefferson County District Court against her employer HSMTX/Lindbergh-Beaumont, which does business with Beaumont Health Care Center.

Bertha Jackson, from Jefferson County claims that she sustained bodily injuries after falling in the Beaumont Health Care Center parking lot. The Southeast Texas Record reports that Ms. Jackson's lawsuit states that "There was a condition in the parking lot of the premises which posed an unreasonable risk of harm."

Yet Ms. Jackson's case isn't all that common for Texas employment lawyers. Many companies will actually provide workers' compensation for employees that are injured in the workplace. FindLaw describes workers' compensation as a no-fault system in which employers will often provide compensation for lost wages, medical costs, and occupational rehabilitation expenses for injuries at work without regard for personal negligence or fault. In exchange for compensation, FindLaw states that employees usually give up the right to sue their employers for negligence or personal damage. In the case with the lawsuit against Beaumont Health Care Center, Ms. Jackson says that the employer did not subscribe to Texas Workers' Compensation. Hence, she is suing the company for actual damages. Her case has been assigned to Judge Milton Shuffield in the 136th District Court.
